    Description

    Die Vorlesungen werden im akademischen Jahr 2026/27  gestreamt.

    Die Übungen werden im akademischen Jahr 2026/27  nicht gestreamt.

    Die Vorlesung und die Übungen vermitteln Grundlagenkenntnisse in Hinblick auf die Entstehung, Durchsetzung und Verwissenschaftlichung des Rechts im Laufe seiner Geschichte.

    Dargestellt werden die wichtigen Etappen auf dem Weg zur Herausbildung u.a. der modernen Privatrechts- und Strafrechtsdoktrin und die Entwicklung zentraler Rechtsfiguren des materiellen und formellen Rechts. Thematisiert wird auch die Entstehung neuerer Rechtsgebiete wie das Arbeits- und Sozialversicherungsrecht oder das Haftpflicht- und Transportrecht. Wichtig ist stets die Einbettung der rechtshistorischen Entwicklung in ihren politischen, ökonomischen und sozialen Kontext und der Vergleich mit dem geltenden Recht.

    Die Lektüre und Diskussion von historischen Texten dient der Veranschaulichung und Vertiefung; in den Übungen wird auch der Vorlesungsstoff repetiert.
    Training objectives

    Die regelmässige Teilnahme an der Vorlesung und den Übungen, die aktive Mitwirkung in diesen sowie die Vor- und Nachbereitung des Vorlesungs- und Übungsstoffes bilden Gegenstand des Lernprozesses.

    Ziel des Kurses ist es, die zentralen Themen und Konzepte der Rechtsgeschichte zu verstehen, im Umfang wie diese im Inhaltsverzeichnis zur Vorlesung (siehe "Aufbau der Vorlesung" im Reader Quellen und Übungsmaterialien) aufgelistet sind.
    Descriptions of Exams

    Die Prüfung wird grundsätzlich in allen Sessionen schriftlich abgenommen. Es werden keine Hilfsmittel zugelassen.

    Geprüft wird sowohl der Inhalt der Übungen wie auch jener der Vorlesung; dazu gehören auch alle behandelten Texte.

    Zur Vorlesung werden sowohl ein Skript als auch eine Quellensammlung benötigt.

    Neben den oben erwähnten Unterlagen und den auf Moodle zur Verfügung gestellten Dokumenten werden für den Kurs folgende zwei Bücher empfohlen:

    • Pahud de Mortanges, Schweizerische Rechtsgeschichte, 3., ergänzte und verbesserte Auflage, Zürich/St.Gallen 2024.
    • Senn/Gschwend/Pahud de Mortanges, Rechtsgeschichte, 3. Auflage, Zürich/Basel/Genf 2012.
