    Contracts : From National to Transnational and European Law

    The object of this class is to provide a comparative study of contract law. On the basis of cases, the focus is on the differences between the civil law and the common law approaches to questions such as formation, mistake and remedies. The course will include a study of the various attempts made to unify or harmonize the law of contracts, both on a global scale (CISG, UNIDROIT Principles) as well as on a European level (Principles of European Contract Law).

    This course is for MLaw and LLM students. Throughout the course, students will be invited to exchange knowledge about their own legal system and learn different approaches to the same problems based on cultural and language differences.

    Objectives

    The objective of the course is to provide future contracts practitioners the tools required to understand how contracts function in international transactions. Students should also receive the means to engage in comparative legal analysis.
