Democratic Representation in International Organizations
Status: LaufendBeginn 01.01.2026 Ende 30.06.2026 Finanzierung SNF Projektblatt öffnen International organizations (IOs) play a central role in contemporary international law-making. From the perspective of the democratic legitimacy of international law, this raises the question of the conditions under which those IOs may be regarded as democratic representatives of their Member States’ peoples. When one knows how powerful and even dominating certain IOs and certain States within those IOs have become politically, the stakes of those IOs’ democratic representativeness are extremely high. Curiously, however, this does not seem to be much of a concern of IOs and their Member States, at least if one refers to the international law of IOs. The question of democratic representation (by [the representatives of] Member States and/or other public or private institutions involved in their law-making and decision-making processes, such as cities, regions, indigenous peoples, non-governmental organizations, multinational corporations, employer’s associations, trade unions or patients’ associations) in IOs, but also by IOs in and of themselves remains moot, to say the least. Even more curiously, while the question of democratic representation in and by IOs is straightforward enough from a democratic legitimacy perspective, it has only rarely been addressed as such in scholarly debates pertaining to the democratic legitimacy of IOs. The latter have focused on democratic deliberation and participation only, while theories of democratic representation have mostly concerned themselves with domestic politics. It is this gap not only in the practice of democratic representation in IOs, but also in the literature that this volume purports to fill. It is the first edited collection on the topic in English language and the first one bringing democratic theorists and international IO lawyers into a dialogue on the issue. Institutionalizing the Human Right to Science
Status: LaufendBeginn 01.01.2022 Ende 31.12.2026 Finanzierung SNF Projektblatt öffnen The human right to science has long been guaranteed by international law, yet it remains largely unexplored by human rights practitioners and scholars. In short, it pertains to the interests of every researcher, but also of everyone, to participate in the scientific enterprise (i) and to access to the benefits of scientific progress (ii), as well as to be protected against the adverse effects of science (iii). Following the recent multiplication of recommendations and comments on the right to science by various international organizations, the right has been re-discovered and scholarly interest has been rising ever since. In order not to approach the right as the cure to all ills of scientific innovation and emerging technologies, however, it is important that international human rights lawyers develop fundamental research on some of the important gaps remaining in the conceptual and normative framework of the human right to science. The present project proposes to address the most important of those: the gap pertaining to the institutional dimension of the right to science, i.e. the so-called “supply-” or “duty-side” of the right. There is very little clarity, indeed, about the identity of the right’s duty-bearers, but also, more generally, of its responsibility-bearers, whether they are national, infranational or international institutions and whether they are public or private, on the one hand. Nor do we know much about how to coordinate those different institutional duty-bearers and responsibility-bearers on a universal scale in order to ensure the required co-specification and co-allocation of their respective duties and responsibilities, on the other. Unlike what is the case for other human rights, indeed, the duties and responsibilities that arise under the human right to science are not only owed by every State or international organization to people under its (territorial or extraterritorial) jurisdiction, but ought also be regarded, this project argues, as collective human rights duties, i.e. duties and responsibilities those institutions bear together. The justification for their collective dimension resides in the universal scope of the public good of science, but also, by extension, in that of the standard threats to the interests in that good. This much sought-after, but rarely defined “international cooperation” pertaining to the human right to science is not only a condition of the feasibility of the protection of those interests against global threats, but also of the overall fairness of the burden on each of the duty-bearing States or international organizations of jurisdiction. This project proposes to explore the ways to institutionalize those duties and responsibilities of international cooperation relative to the human right to science, including through the creation of new international institutions if required. The project also aims to address three more specific institutional gaps: first, the domestic and international institutional implications of citizen science and of everyone’s right to equal participation in the practice and organization of science; second, the domestic and international institutional dimensions of the duties of anticipation of the benefits, but also of the (risks of) adverse effects of science, including duties of diligent precaution and prevention arising under the human right to science; and, finally, the institutional dimensions of the inclusion in the scope of the right of non-Western forms of knowledge. In light of the contemporary surge of practice and scholarship on the human right to science and of the general and specific institutional gaps identified therein, the project’s outcomes should be of utmost scientific relevance. Moreover, qua project in fundamental legal research whose method includes, as in this case, both accounting for and guiding the practice of law, this project’s scientific relevance is indissociable from its practical impact on the laws that institute, promote and curb science. That impact will be enhanced by the association of human rights practitioners and “science diplomacy” actors in the project’s conferences and publications. More generally, and beyond the law, it is difficult to think of a topic that could be of a higher political, but also social and economic relevance today than the question of the domestic and international institutionalization of equal access to scientific innovation and of the anticipation of its risks and benefits for humanity. The Sources of International Law
Status: AbgeschlossenBeginn 01.12.2014 Ende 31.03.2018 Finanzierung SNF Projektblatt öffnen The research project The Sources of International Law pertains to how international law is made today, i.e. by which processes its rules (provided they are rules) become rules of international law (provided it is law), and thereby acquire legal validity. Sources are a central question in international law, both in practice and theory. Not only is it important for practitioners to be able to identify valid international legal norms and hence the specific duties that stem from international law, but also the topic has great theoretical significance. Clarifying it helps understanding the nature of international law itself, i.e. the legality of international law. Furthermore, accounting for the sources of international law means explaining some of the origins of its normativity, as well as discussing potential justifications for its authority and the exclusionary “reasons to obey” which it places on its subjects, and hence its legitimacy. Although and, probably, because it is one of the key questions in international law, the identification of the sources of international law also remains one of the most controversial ones in international legal scholarship. Moreover, law-making is one of the areas of the practice of international law that has changed most radically over the last 50 years, and since the list of sources of international law of Article 38 Statute of the International Court of Justice (ICJ) was last revised in 1945. It is not surprising therefore that international lawyers feel the need every so often, and even more often recently, to revert to it, to take stock and to provide an in-depth and general assessment of contemporary international law-making. The present project aims at doing exactly that. Qua umbrella-project, it proposes to do so in two-ways: first, and foremost, through organizing the edition and publication of the Oxford Handbook on the Sources of International Law that has just been commissioned by Oxford University Press to the applicant and her co-editor, Prof. Jean d’Aspremont (Universities of Manchester & Amsterdam) and, secondly, and more generally, through launching companion-research on specific aspects of the question by a doctoral student and a post-doctoral researcher. Oxford Handbooks are designed to offer authoritative and state-of-the-art surveys of current thinking and research in a particular subject area. The preparation and publication of such a handbook on the question of sources of international law provides the occasion to review the state of the theory of sources in international law and to take a fresh look at some of its old chestnuts and even identify new challenges. The Oxford Handbook on the Sources of International Law will be the very first comprehensive edited reference work devoted to the question of the sources of international law. It aims to provide an accessible and systematic overview of key issues and debates about the sources of international law. It also purports to offer an authoritative theoretical guide for anyone studying or working within, but also outside international law wishing to understand one of its foundational questions. The Oxford Handbook will feature 48 original essays by leading international law scholars and theorists from a range of traditions, nationalities and perspectives, in order to reflect the richness and diversity of scholarship in this area. Its specificity and novelty will lie not only in the broad range of theories represented, but also in its dialectical approach between the two chapters addressing each topic and in its strong jurisprudential or philosophical emphasis. Besides its general scientific impact in international legal scholarship, both doctrinal and jurisprudential, and its importance for the practice of international lawyers, the project will also contribute to the consolidation of doctoral and post-doctoral research in international law and, in particular in international legal theory, in Swiss law schools. Status: AbgeschlossenBeginn 01.10.2012 Ende 31.01.2017 Finanzierung SNF Projektblatt öffnen Le présent projet de recherche a pour objectif de proposer une interprétation de l’art. 52 (1) de la Charte des droits fondamentaux de l’Union européenne (« la Charte »). Cette disposition énonce les conditions auxquelles l’exercice d’un droit ou d’une liberté peut être restreint. Issue de la jurisprudence de la Cour de justice de l’UE (« CJUE »), elle-même fondée sur les pratiques nationales en la matière et la Convention européenne des droits de l’homme (« CEDH »), l’art. 52 (1) de la Charte complète la pratique existante en matière de restriction des droits fondamentaux en y important des éléments issus des critères de restriction des droits contenus dans la CEDH tels qu’interprétés par la Cour européenne des droits de l’homme («CourEDH»), d’une part, mais aussi des éléments entièrement nouveaux, d’autre part. L’interprétation de l’art. 52 (1) de la Charte demeure cependant encore ouverte, et la CJUE ne s’est qu’encore très peu risquée à l’appliquer. Outre la complexité morale liée à la restriction d’un droit fondamental en principe prioritaire sur tout autre intérêt ou considération morale et les difficultés philosophiques qui s’ensuivent, les difficultés proprement juridiques sont en effet multiples. Fort de ce constat, le projet de recherche propose une lecture de l’art. 52 (1) de la Charte qui soit à la fois normativement correcte, corresponde à la nature et au rôle des droits fondamentaux de l’UE et respecte l’exigence de cohérence, requise par l’art. 52 (3) de la Charte, avec la jurisprudence de la Cour européenne des droits de l’homme (« CourEDH ») en matière de restriction des droits de la CEDH. Fondé sur une analyse comparative jurisprudentielle et doctrinale, le projet de recherche se veut aussi empirique et prospectif, prenant particulièrement en compte le contexte européen actuel. Aucune analyse de compatibilité des critères matériels de restriction contenus dans la Charte et la Convention n’existe à ce jour. Or, au vu de l’avancement des négociations sur l’adhésion de l’Union européenne à la CEDH et du contrôle de conventionalité qu’elle instaurera, le projet de recherche permettra d’offrir aux juridictions de contrôle, tant nationales que supranationale et internationale, un outil susceptible de faciliter une application cohérente de l’art. 52 (1) de la Charte et de limiter les divergences interprétatives avec la CEDH. Une telle approche permettrait également d’assurer une meilleure mise en œuvre des droits fondamentaux contenus dans la Charte dans les Etats membres de l’UE. Status: AbgeschlossenBeginn 01.10.2011 Ende 31.12.2015 Finanzierung SNF Projektblatt öffnen Le module de formation doctorale (MF ProDoc), Fondements du droit européen et international, a pour objectif de développer en Suisse la recherche fondamentale et interdisciplinaire sur les fondements du droit international et en droit europe´en et ceci grâce à un encadrement rapproché des thèses de doctorat et à l’organisation d’un certain nombre d’activités telles que colloques doctoraux, séminaires-bloc, rencontres annuelles, séminaires d’appui, enseignements et conférences spécialisés, ainsi qu’un groupe de discussion. Il vise à prodiguer aux doctorants une formation fondamentale essentielle à mener à bien un projet de recherche de qualité, d’une part, et de l’aide dans la préparation de leur insertion professionnelle dans le milieu académique, d’autre part. Plus largement, le programme doctoral proposé devrait permettre non seulement d’encourager la rédaction de thèses de doctorat de haute qualité, mais aussi de fournir une contribution importante à la recherche scientifique en suscitant une réflexion encore lacunaire mais nécessaire sur les fondements tant philosophiques que politiques, économiques, historiques ou sociologiques des ordres juridiques développés au-delà des frontières étatiques que sont les ordres juridiques international et européen. La Cour européenne des droits de l’homme après le Protocole 14 - Premier bilan et perspectives
Status: AbgeschlossenBeginn 01.05.2011 Ende 31.07.2011 Finanzierung SNF Projektblatt öffnen Le 1er juin 2010, le Protocole 14 à la Convention européenne des droits de l’homme est finalement entré en vigueur après plusieurs années d’incertitude. Ce Protocole apporte un certain nombre de réformes importantes et désormais connues au fonctionnement de la Cour, réformes qui devraient permettre de corriger certaines des difficultés et retards accumulés à ce jour. L’entrée en vigueur apporte néanmoins son lot de questions puisque nombre de points procéduraux et matériels n’ont pas pu être résolus par la mise à jour du Règlement de la Cour et devront recevoir une réponse en pratique. Par ailleurs, comme l’avaient annoncé de nombreux spécialistes, de nombreuses autres réformes sont requises afin de rendre la Cour plus efficace et le Protocole 15 est déjà en discussion. Cette conférence aura pour objet tout d’abord de faire le point sur l’entrée en vigueur du Protocole et tirer un bilan d’une première année de fonctionnement de la Cour dans ce nouveau cadre en identifiant les points qui doivent encore être améliorés. Il s’agira ensuite de reprendre la question désormais permanente de la réforme de la Cour à l’aune de la Déclaration et du Plan d’action adoptés à l’issue de la Conférence d’Interlaken sous l’égide de la présidence suisse du Conseil de l’Europe le 19 février 2010. Status: AbgeschlossenBeginn 01.11.2008 Ende 30.04.2011 Finanzierung SNF Projektblatt öffnen Le projet est un projet de recherche bilingue français-anglais consacré à l’étude non seulement de la nature démocratique de la politie européenne, mais aussi de son impact sur la validité et la légitimité du droit européen. Il s’agit donc à la fois d’un projet en théorie politique et d’un projet en théorie du droit. Si la question de la démocratie européenne a déjà fait l’objet de nombreuses études, sa relation aux questions difficiles qui entourent la nature et la structure de l’ordre juridique européen n’a pas encore été beaucoup explorée. Il ne s’agira pas, en effet, ici uniquement de considérer les modalités juridiques du fonctionnement démocratique de l’Union européenne (UE), mais plutôt la nature et l’impact de ce fonctionnement sur la création du droit de l’UE et son application dans les Etats membres. L’inverse est aussi vrai ; la théorie démocratique européenne ne s’inspire que rarement de l’organisation pratique des mécanismes de production du droit européen et de sa mise en oeuvre en droit national. Il est difficile, en effet, de se pencher sur les détails souvent très techniques du fonctionnement de la procédure législative, de la délégation législative et de la mise en oeuvre du droit de l’UE par les institutions de l’UE, mais aussi par ses Etats membres. La question est particulièrement actuelle dans la mesure où le Traité modificatif de Lisbonne signé le 13 décembre 2007 introduit un certain nombre de principes démocratiques dans les traités fondateurs et notamment le principe de l’égalité politique, de la démocratie représentative et de la démocratie participative. Même si ces principes sont généraux et non-justiciables, d’autres nouveautés plus concrètes doivent être mentionnées et notamment l’initiative citoyenne européenne, qui permet à un million de citoyens de déposer une initiative législative auprès de la Commission européenne, et le renforcement du rôle des parlements nationaux dans le processus législatif européen. Si la question du déficit démocratique a été explorée ad nauseam par les milieux scientifiques depuis le début des années 1990 et si l’échec du Traité établissant une Constitution pour l’Europe a remis en cause une bonne partie du discours constitutionnel européen, ces nouveaux développements rappellent que la question politique des fondements de la légitimité du droit de l’UE est encore loin d’être résolue. Et ceci appelle un réexamen de la question à la lumière des leçons à tirer des débats constitutionnels des trois dernières années et une discussion de la pratique à suivre dans les Etats membres pour que ces nouveaux instruments de la démocratie européenne soient porteurs de la légitimité complexe dont a besoin la politie européenne. Enfin, la question est particulièrement intéressante en Suisse, où avec ou sans intégration l’impact du droit européen se fait ressentir sur les institutions et processus démocratiques internes. L’étude plus approfondie des rapports entre démocratie et droit dans un ordre juridique sui generis intégré, mais pluraliste comme l’ordre juridique européen est fondamentale pour bien comprendre la légitimité actuelle et future du droit suisse. La voie bilatérale qui a été formellement choisie par nos autorités nous apporte certes le confort d’un processus intergouvernemental de législation par traité et comité mixte, mais sa légitimité démocratique ne saurait longtemps être assurée par de telles procédures vu l’ampleur et la profondeur des changements législatifs apportés. Il s’agira donc de voir comment l’ordre juridique suisse peut bénéficier des changements liés à la démocratisation des processus européens et trouver une voie propre qui correspond aux attentes politiques de Bilatérales. Ce projet de recherche est un des premiers modules de recherche du ProDoc Ecole doctorale sur les fondements du droit européen dont la requérante principale est aussi la requérante du présent projet. Status: AbgeschlossenBeginn 01.10.2008 Ende 30.09.2011 Finanzierung SNF Projektblatt öffnen Le module de formation doctorale a pour but de développer la recherche fondamentale dans le domaine des études juridiques européennes en Suisse romande grâce à l’encadrement rapproché des thèses de doctorat, à l’organisation de colloques des doctorants bisannuels, d’enseignements spécialisés, de séminaires d’appui et de groupes de discussion. Les études juridiques européennes sont, comme d’aucuns s’en étonnent souvent, un des points forts des Facultés de droit helvétiques. Du point de vue de la recherche doctorale, cependant, il n’existe pas ou plus de structures existantes dans ce domaine en Suisse et notamment en Suisse romande, d’où l’intérêt du projet proposé. L’Ecole doctorale romande en études européennes de l’Institut européen de l’Université de Genève (IEUG), financée par le Triangle Azur depuis 2003, prend fin en 2008. Avec l’accord de tous les partenaires, le ProDoc en reprendrait les fondements en l’élargissant aux autres universités de Suisse romande et en la relocalisant à Fribourg du fait notamment de son Institut de droit européen et de sa situation privilégiée au coeur de la Suisse. Le ProDoc Ecole doctorale romande sur les fondements du droit européen permettrait de créer un pôle d’excellence doctoral dans le domaine du droit européen autour des quatre universités romandes que représentent les requérants (Prof. Samantha Besson et Prof. Pascal Pichonnaz pour Fribourg ; Prof. Nicolas Levrat pour Genève ; Prof. Evelyne Clerc pour Neuchâtel ; et Prof. Andreas Ziegler pour Lausanne) et de leurs universités partenaires en Suisse et à l’étranger. Les Universités de Fribourg, de Neuchâtel, de Lausanne et de Genève disposent toutes d’instituts renommés dans le domaine des études européennes : c’est le cas dans le domaine des études européennes interdisciplinaires pour l’Institut européen de l’Université de Genève, dans le domaine du droit européen pour l’Institut en droit européen des Universités de Berne, Fribourg et Neuchâtel (BENEFRI) basé à Fribourg et dans le domaine du droit économique européen et international pour le Centre de droit comparé, européen et international (CDCEI) de l’Université de Lausanne. Ces universités et instituts ont une longue tradition de recherche fondamentale en droit européen et c’est dans l’idée d’en faire bénéficier leurs doctorants qu’elles soumettent ce projet. Le MAS en études européennes de l’IEUG, le Consecutive Master in European Studies de l’Université de Fribourg et le MAS/LLM en droit international et européen de l’économie et des affaires de l’Université de Lausanne sont trois exemples de la qualité de la formation dans ces institutions et de leur aptitude à former de futurs doctorants en études européennes et participants au ProDoc. Plus concrètement, le financement par la CUS du Masters of Law in Cross-Cultural Business Practice (MLCBP) des Universités de Berne et de Fribourg dès la rentrée 2009 renforcera encore la qualité du pôle de recherche en études européennes et comparées dans lequel s’insérera le ProDoc proposé. Les cinq professeurs requérants sont actifs dans le domaine de la recherche sur les fondements du droit européen, soit dans le cadre de la recherche historique et comparative (p.ex. étude du droit commun romain, puis du droit privé européen et comparé pour le Prof. Pichonnaz), soit dans le cadre de la recherche philosophique et politique (p.ex. étude des sources, de la nature et de la légitimité de l’ordre juridique européen pour la Prof. Besson ou étude du régionalisme et du fédéralisme européens pour le Prof. Levrat), soit enfin dans le domaine des fondements économiques du droit européen (p.ex. droit des marchés publics et de la concurrence européens pour la Prof. Clerc et droit commercial et des affaires européen pour le Prof. Ziegler). Ces cours sont fondés sur des éléments réalisés par des enseignant-es de plusieurs universités (cf. ci-dessous) selon un plan modulaire commun. Ils sont ensuite assemblés dans le cadre de cours adaptés à la langue, au programme et au niveau de connaissance des étudiant-es des différentes univesités. Ces cours sont intégrés dans le programme Campus virtuel suisse (leader: Université de Fribourg) et dans le réseau Campus numériques français (leader: Université Robert Schuman). Dans un avenir proche, les cours European Law online seront également diffusés sous la forme d'un programme de master en ligne.
