    Description

    Care work – unpaid work performed within close relationships – is socially indispensable yet only partially captured by law. This seminar examines how Swiss law currently regulates care work (family law, inheritance law, labour law, and social security law) and compares it with foreign regulatory models that anchor recognition to the care work performed rather than to status categories such as marriage and kinship. On this comparative basis, students critically assess which regulatory approaches might be relevant to Swiss law reform debates.

    This course is conducted as a seminar. Active participation in every session is expected, and each student will be required to prepare and present one topic from the course syllabus over the semester.

    Training objectives

    Upon completion of the seminar, students will be able to:

    • Identify the key areas of Swiss law governing care work and pinpoint their regulatory gaps;
    • Systematically compare foreign regulatory models and classify their underlying logic (status-based vs. care-based recognition);

    Critically assess which elements of foreign models could be relevant to Swiss law reform debates.
